In our filing, which can be read by clicking this link: <a title="Response to UF's Motion to Dismiss" href="http://solveuf.com/wp-content/uploads/2009/04/responseufmotdismiss.pdf" target="_blank">responseufmotdismiss</a>, we point out the numerous inconsistencies and object to the demeaning tone UF uses toward the legal standing of students and Student Government in the State of Florida.  We hope the Court will choose to continue hearing the case, and if it does, will be filing our response to UF&#8217;s brief on the merits later this month.</p>

			<content:encoded><![CDATA[<p>Today the University of Florida was finally forced to respond on the merits for the first time to the SOLVe lawsuit, almost exactly 13 months after the first documents were filed (more than 16 months since the first signatures were collected!)  In their brief, the University argues that they have unlimited power in SG matters and no matter how outrageous their decision might be, that SG isn&#8217;t &#8220;real&#8221; and so no student could actually be injured by anything they do.  They also claim that the University hasn&#8217;t actually taken any final action on the Online Voting Amendment, a claim anyone who has signed the petition or helped SOLVe should find hilarious. </p>

			<content:encoded><![CDATA[<p>Chief Judge Smith of the 8th Judicial Circuit has ruled that our case is more properly placed at the First District Court of Appeals in Tallahasee, FL.  Since we filed a parallel case with the 1st DCA in March, he has dismissed the local Gainesville petition.  He noted, among many other things, however, that many of UF&#8217;s assertions in their flurry of briefs were wrong and that UF&#8217;s procedure for handling issues dealing with the SG Supreme Court is &#8220;troubling.&#8221;  <a href="http://solveuf.com/wp-content/uploads/2009/03/8thjudicialcircuitordertodismiss.pdf" target="_blank">Read it here.</a></p>

			<content:encoded><![CDATA[<p>This morning SOLVe responded to UF&#8217;s motion to dismiss with a 3-part response asking UF&#8217;s motion be denied.  The response reasserts and explains how the 8th Judicial Circuit Court does have jurisdiction on this matter under the Florida Constitution and points out that the matter at hand needs no special agency expertise since it is a clear question whose appeal to Tallahassee would be unnecessarily burdensome.  In the alternative, if the Circuit Court decided it did not have jurisdiction, the response filed shows that the proper remedy would be to transfer the case to the 1st District Court of Appeal and not to dismiss it.  The full text of our filing can be read by <a href="http://solveuf.com/wp-content/uploads/2009/03/solveresponsetomotiontodismiss03-20.pdf" target="_blank">downloading the PDF.</a></p>
