SOLVe Responds to UF’s Attempt to Dismiss Case

This morning SOLVe responded to UF’s motion to dismiss with a 3-part response asking UF’s motion be denied.  The response reasserts and explains how the 8th Judicial Circuit Court does have jurisdiction on this matter under the Florida Constitution and points out that the matter at hand needs no special agency expertise since it is a clear question whose appeal to Tallahassee would be unnecessarily burdensome.  In the alternative, if the Circuit Court decided it did not have jurisdiction, the response filed shows that the proper remedy would be to transfer the case to the 1st District Court of Appeal and not to dismiss it.  The full text of our filing can be read by downloading the PDF.

UF Questions Court’s Ability to Consider SOLVe Case

The University of Florida has filed a motion to dismiss the SOLVe case for various technicalities.  In the filing they even suggest that no court would have the jurisdiction to ever review any decisions of the SG Supreme Court.  Clearly this would be a horrendous precedent and essentially coronate the SG Supreme Court as the kings, not the justices of UF SG and possibly even issues spreading to the rest of the state of Florida.  We of course strongly disagree with their filing and look forward to defeating their motion and moving forward with the case.  Their filing can be read by clicking here.
